Supreme Commander ONLINE Tournament: THE AEON ASCENDANT
Official Rules
Gas Powered Games Corp. is pleased to announce an online prize tournament for the Aeon Ascendant, a Supreme Commander tournament via GPGnet, (the "Tournament"). By entering the Tournament you expressly agree to and
accept these "Official Rules" and represent you
satisfy ALL eligibility requirements described below. Any violation of these Official
Rules may result in your ejection from the Tournament and a possible ban from future
play on GPGnet. All applicable federal, state, and local laws and regulations
apply. This offer is void where prohibited by law. NO PURCHASE NECESSARY
TO ENTER OR WIN.
1.
Sponsor: The Tournament is sponsored by Gas Powered Games Corp. (5000
148th Avenue North East #200, Redmond, Washington 98052)
2.
Eligibility Requirements:
i.
The Tournament is open only to individuals who at the time of entry: (a)
are legal residents of the United States (excluding residents of Florida, New
York, and Rhode Island), Canada (excluding residents of Quebec), Mexico, or the
following member states of the European Union (Austria, Denmark, Finland,
France, Germany, Great Britain, Greece, Italy, Luxemburg, The Netherlands,
Spain, and Sweden); (b) are at least sixteen (16) years of age; (c) have a
personal computer that meets the recommended published requirements to run
Supreme Commander; (d) have Supreme Commander with the most recent patch
applied; (e) a GPGnet account (required to access the online multiplayer component
of Supreme Commander); (f) a stable broadband Internet connection; and (g) have
played at least five (5) ranked games (the "Eligible Participants").
ii.
Any individuals under the age of eighteen (18) at the time of entry must
have the permission of a parent or legal guardian to enter and participate.
iii.
Directors, officers and employees of Sponsor, and any of Sponsor’s
respective affiliate companies, subsidiaries, agents, professional advisors,
advertising and promotional agencies, and immediate families of each are not
eligible to enter any Tournament or win any prizes.
iv.
Your entry constitutes your full and unconditional agreement to and
acceptance of these Official Rules and the decisions of Sponsor, which are
final and binding on all matters pertaining to this Tournament.
v.
You may compete in the
Tournament and/or win a prize only if it is legal to do so in your country,
state/province, and locality. If it is not legal for you to participate in
the Tournament, any prize for which you are eligible will be void and you may
be barred from future GPGnet play.
3.
NO PURCHASE NECESSSARY: Other than the costs incurred in
purchasing Supreme Commander, there are no additional purchases or costs
necessary to enter or win.
4.
How to Enter: Log into the GPGnet client, and click on the GPGnet
"Game" menu. Use the Tournament Schedule Calendar to
locate the tournament you wish to enter, then click on
"Register".
5.
Account Information and One Account: All Eligible Participants
must have a GPGnet account in good standing. By entering the Tournament,
Eligible Participants warrant that all information pertaining to their GPGnet
account is current and accurate. Participants are prohibited from entering the
Tournament using more than one (1) GPGnet account. Any entrant found to have
entered using more than one (1) GPGnet account will be immediately disqualified
from the Tournament.
6.
Chances of Winning: Chances of winning depend upon the number of
Eligible Participants who enter the Tournament.
7.
Tournament Period: The Tournament shall commence on October 27th,
2007, and is
expected to conclude on October 28th, 2007
8.
Player Ratings and Tournament Eligibility:
i.
Player Ratings: Players must have played at least twenty (20)
ranked games to establish rating class eligibility for each of the five (5) rating
class Divisions. Players who have not yet established a player rating shall
only be eligible to participate in the Open Division. A player’s rating class at
the start of the Tournament will be used to establish rating class prize
eligibility.
ii.
Open Division: All Eligible Participants may enter the Open
Division.
iii.
Intermediate Division: Only Eligible Participants who have established
a rating of 2100-1800 are eligible to enter the Intermediate Division.
iv.
Commander Class Division: Only Eligible Participants with an
established rating of 1799 or below may enter the Commander Class Division.
9.
Prizes: All prizes are void where prohibited by law. Prizes will
be awarded to the participants in the North America Tournament and the European
Union Tournament who finish as follows:
i.
Open Division: 1st place - $1,000.00 U.S.; 2nd place - $500.00 U.S.; 3rd place - $250.00 U.S.; 4th place
- $150.00 U.S.; 5th place - $100.00 U.S.; 6th-10th
places - $50.00 U.S. each.
ii.
Intermediate Division: Rated 1800-2100: 1st place - $500.00 U.S.; 2nd place - $250.00 U.S.; 3rd place - $100.00 U.S.; 4th-10th
places - $50.00 U.S. each.
iii.
Commander Class Division: Rated <1800 : 1st place - $500.00 U.S.; 2nd place - $250.00 U.S.; 3rd place - $100.00 U.S.; 4th-10th
places - $50.00 U.S. each.
Top five (5) players under 1600, $50;
10. Notification
and Validation of Winners: All
winners will be notified by e-mail or telephone at the e-mail address or
telephone number associated with their GPGnet accounts. To claim their prize,
winners must complete and return a notarized Affidavit and General Release and,
if applicable, a W-9 form sent to winner, within five (5) days of
notification. If winner is a resident of a jurisdiction that deems winner to
be a minor, the prize may be awarded in the name of winner’s parent/legal
guardian, who must also sign a notarized Affidavit and General Release on the
winner’s behalf and grant consent for the winner to accept the prize. Any prize
notification or prize returned to Sponsor as undeliverable will be forfeited.
Each potential winner may be requested to provide Sponsor with proof that
he/she is the authorized account holder of the e-mail address that corresponds
to the registered GPGnet account used to enter the Tournament. In the event of
a dispute regarding who submitted an entry, the entry will be deemed submitted
by the authorized account holder of such e-mail account. You are not a winner until your submission is
validated and your documents are completed.
11. Prize
Distribution: All prizes shall be distributed via PayPal without
exception. Following the validation of the winner’s submission (see Notification
and Validation of Winners above), players have thirty (30) days to establish
a PayPal account to receive payment. After this time, any unclaimed prize will
be forfeited. Prizes may not be transferred nor assigned. Prizes may not be
substituted or exchanged, except at the sole discretion of Sponsor for a prize
of equal or greater value.
12. List of
Winners/Official Rules: A list of winners will be posted at http://tournaments.gaspowered.com
no later than November 2nd, 2007. For a printed copy of the list of winners please
send a stamped, self-addressed, business-sized envelope after October 27th, 2007 and
before November 2nd, 2007 to: Gas Powered Games Corp., Aeon Ascendant Winners List, 5000 148th Avenue North East #200, Redmond, Washington 98052. For a printed
copy of these Official Rules please send a stamped, self-addressed,

13. Tax
Matters: Eligible Participants are solely responsible for all federal,
state, VAT, withholding, municipal or other governmental taxes, duties,
licenses, fees, excises or tariffs now or hereafter imposed and any other costs
incurred in connection with participation in the Tournament and receipt of any
prize. Winners shall complete and submit to Sponsor any applicable tax forms
required to receive a cash prize.
14. Technical
Requirements: All Eligible Participants must have:
i.
a personal computer that meets the recommended published requirements to
run Supreme Commander;
ii.
Supreme Commander with the most recent patch applied;
iii.
a GPGnet account (required to access the online multiplayer component of
Supreme Commander); and
iv.
a stable broadband Internet connection.
15. Tournament
Directors: The GPGnet Tournament is operated and monitored by Tournament
Directors. Tournament Directors are volunteers who have been authorized by Sponsor
to oversee the Tournament. The decisions of the Tournament Directors are
final, unappealable, irreversible, and completely supported by Sponsor.
16. Pairings:
The rules for each type of pairing system utilized for the Tournament are
posted in the GPGnet Knowledge Base (Keyword: Pairings). Where possible,
these rules will be followed. Tournament Directors have the right to manually
override pairings, if necessary.
17. Connection
Issues: Eligible Participants who have difficulty connecting to other
players should resolve these problems before entering the Tournament. The
Tournament Directors may disqualify players who have repeated connection
problems. Players must be online and ready to play when Tournament pairings
are made. In the event connection issues prevent a Player from connecting for
a round, the Tournament Directors will make efforts to find alternate pairings
for the players. If alternate pairings are not available, or prevent the
timely start of a round, the Tournament Directors may declare the round a
draw. In the event a Player becomes disconnected and cannot reconnect within a
reasonable amount of time, the Tournament Directors in their sole discretion
may declare a forfeit in favor of the connected party.
18. Withdrawal:
Eligible Participants are free to withdraw from a Tournament at any time via
the "withdraw" function of GPGnet or by properly notifying a Tournament
Director (and receiving acknowledgement from same). Once withdrawn, a player
may not re-enter the Tournament - No Exceptions.
19. Tournament
Game Play Rules: By entering the Tournament, Eligible Participants acknowledge
they have read and agree to abide by the Tournament Game Play Rules at all
times. These rules may be found at http://tournaments.gaspowered.com/rules.
The Tournament Game Play Rules are subject to change at any time. If any changes
to these rules occur, players will be notified on http://tournaments.gaspowered.com/rules.
20. Results:
The GPGnet automatch system will be used to determine the results of all played
games. Tournament Directors reserve the right to declare unilateral
disconnects or game crashes a loss for the disconnected party.
21. Cheating,
Abuse, and Disorderly Behavior: Tournament Directors shall have the
authority to disqualify Eligible Participants upon a finding of any cheating,
abuse, or disorderly behavior. An Eligible Participant disqualified for any
reason shall be prohibited from further participation in the Tournament and
possibly, at the discretion of Sponsor, future GPGnet events.
i.
No cheats or hacks or other 3rd party "helper" applications
shall be used.
ii.
Purposeful disconnection or collusion with other players shall be
considered cheating.
iii.
It is the player’s responsibility to understand and avoid all current
illegal exploits. Taking advantage of known exploits in the game is also
considered cheating. Exploits in the game could include, without limitation,
bugs that allow you to hide under obstacles or objects in the game to gain
invulnerability. If a Tournament Director finds that you are cheating, you
will be disqualified immediately from the Tournament.
iv.
Courtesy and respect are expected at all times between Eligible Participants
and in dealing with Tournament Directors, or other GPGnet officials. Harassing,
negative, or profane language in either the Tournament chat or the game will
not be tolerated.
22. Intellectual
Property: Sponsor has certain protectable proprietary rights in its
software and websites, including copyrights and trademarks. You may not
modify, copy, publish, republish, transmit, sell, create derivative works,
display or in any way exploit any content contained on any Sponsor websites, software,
or other property, other than for personal use.
23. General
Conditions and Release:
Except where prohibited by law, each winner (or their parent/legal
guardian should they be a minor in their state of residence) consents to the
use of his/her name, city and state, likeness and entry in any manner by
Sponsor, its designees and its advertising and promotion agencies without
further compensation or notification. Acceptance of a prize constitutes each
winner’s consent (or their parent/legal guardian’s should they be a minor in
their state of residence) to have his or her name released in a winner’s list
which will be made available to the public. By entering this Tournament,
winners (or their parent/legal guardian should they be a minor in their state or
province of residence) agree to release, discharge and hold harmless Sponsor
and any of its affiliates, subsidiaries, divisions, or related companies, or
their respective officers, directors, employees or agents of the foregoing
(collectively, the "Released Parties"), from any liability
whatsoever, and waive any and all causes of action, related to any claims,
costs, injuries, losses taxes, expenses or damages of any kind, either at law
or in equity, whether known or unknown (collectively, "Losses"),
arising out of or in connection with this Tournament or that the winners might
incur as a result of this Tournament or acceptance, possession or use or inability
to use any prize (including, without limitation, losses related to personal
injuries, death, damage to or destruction of property, rights of publicity or
privacy, defamation or portrayal in a false light, whether intentional or
unintentional), whether under a theory of contract, tort (including
negligence), warranty, guarantee (express or implied) or other theory. Winner
(or their parent/legal guardian should they be a minor in their state of
residence) further acknowledges that Sponsor is not liable for any warranty,
representation, or guarantee express or implied, in fact or in law, relative to
any prize, including, but not limited to, its quality, mechanical condition, or
fitness.
24. Disclaimer:
If for any reason the Tournament is not capable of running as planned,
including, but not limited to, infection by computer virus, bugs, tampering,
unauthorized intervention, fraud, technical failures or force majeure that
corrupt or affect the administration, security, fairness, integrity, or proper
conduct of these Tournament, Sponsor reserves the right, at its sole
discretion, to disqualify any individual who tampers with the Tournament and to
cancel, terminate, modify or postpone the Tournament until a later date. The
Released Parties assume no responsibility for any error, omission,
interruption, deletion, defect, delay in operation or transmission,
communications line failure, or other failure of or related to the software
platform on which the Tournament is played. The Released Parties are not
responsible for any problems or technical malfunction of any telephone network
or lines, computer online systems, servers, or providers, computer equipment,
software, failure of any e-mail or entry to be received by Sponsor on account
of technical problems or traffic congestion on the Internet or at any Web site,
or any combination thereof, including any injury or damage to participant's or
any other person's computer related to or resulting from participation or
downloading any materials in this Tournament.
25. ANY ATTEMPT
BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR APPLICATION OR TO
UNDERMINE THE LEGITIMATE OPERATION OF THE TOURNAMENT IS A VIOLATION OF CRIMINAL
AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT
TO SEEK DAMAGES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW.
26. Severability:
In the event one or more provisions of these Official Rules is found to be
invalid, illegal, or unenforceable, such provision shall be severed from these
Official Rules and the remaining provisions shall remain in full force and
effect.
27. Amendment:
Sponsor reserves the right to change or modify these Official Rules at any
time.
